Registration Terms

You must agree to our Registration Terms in order to register for our classes, courses and workshops.  By making full and/or partial payment you agree to these terms and conditions.

This agreement is effective November 1, 2010.  All registrants must be 18 years of age or older.

The following Agreement defines the relationship between Tad & Associates, Ltd dba North Coast Barista School, herein referred to as “North Coast Barista School” and the registrant, herein referred to as “Client.”

AGREEMENT:

1) PAYMENT  Client will pay agreed amount to North Coast Barista School. At the time of registration, Client will pay to North Coast Barista School the full tuition per attendee. 

1a)CANCELLATION/REFUND If Client cancels at any time Client will not receive a refund of any kind, regardless of the reason. If Client is unable to attend, Client may transfer the reservation to another person or transfer the funds to another workshop at North Coast Barista School.  If Client has paid in full and workshop is cancelled, Client can transfer payment to another session or obtain a refund. North Coast Barista School reserves the right to cancel classes for any reason.  Credit will remain active and valid for a period of one (1) year from the date of purchase.  No extensions will be allowed.

2) TRAVEL EXPENSES Client is responsible for the arrangement and payment of all travel-related expenses such as airfare, hotel, car rental, meals (unless specified North Coast Barista School supplies meals), etc.
 

3) LIMITS OF LIABILITY North Coast Barista School will provide general instruction to Client based on North Coast Barista School’s knowledge and experience. Client hereby acknowledges as such and makes all decisions pertaining to Client’s operations and future. North Coast Barista School does not represent or guarantee that Client will be profitable or that attendance and/or completion in its school will make its business successful. Client acknowledges that any success is determined by factors of Client and not North Coast Barista School. Client hereby releases North Coast Barista School from any and all claims, costs, damage or expense in any manner arising out of North Coast Barista School’s performance under this Agreement known or unknown. Client waives any claim for incidental or consequential damages.
 

4) NOTICES Any notices required or permitted to be given hereunder shall be given in writing and shall be delivered (a) in person, (b) by certified mail, postage prepaid, return receipt requested, (c) by facsimile, (d) by a commercial overnight courier that guarantees next day delivery and provides a receipt, or (e) email, and such notices shall be addressed to the last known address of each party hereto, or last known email address or to such other address as either party may from time to time specify in writing to the other party. Any notice shall be effective only upon delivery, which for any notice given by facsimile shall mean notice that has been received by the party to whom it is sent as evidenced by confirmation slip.
 

5) AMENDMENT This Agreement may be amended only in writing and signed by both parties.
 

6) BINDING EFFECT This agreement shall bind the parties hereto, their legal representatives, successors, heirs and assigns. The Assignee assumes and undertakes all of the terms and conditions of the lease as his/her own obligation.
 

7) SEVERABILITY Invalidity or unenforceability of one or more provisions of this Agreement shall not affect any other provision of this Agreement.
 

8) PROFESSIONAL ADVICE Client understands that they should seek advice from an attorney, accountant and other professionals and related to directly or indirectly the coffee business and/or business in general besides North Coast Barista School before making any financial or legally binding decisions regarding any decision.
 

9) FURTHER ASSURANCES The parties shall at their own cost and expense execute and deliver such further documents and instruments and shall take such other actions as may be reasonably required or appropriate to evidence or carry out the intent and purposes of this Agreement or to show the ability to carry out the intent and purposes of this Agreement.
 

10) ATTACHMENTS Any exhibits, schedules, and other attachments referenced in this Agreement are part of this Agreement.
 

11) GOVERNING LAW This Agreement shall be interpreted and construed according to, and governed by, the laws of Ohio, excluding any such laws that might direct the application of the laws of another jurisdiction. The federal or state courts located in Ohio shall have jurisdiction to hear any dispute under this Agreement.
 

12) ATTORNEY FEES In any litigation, arbitration, or other proceeding including but not limited to any proceeding brought under the United States Bankruptcy Code, by which one party either seeks to enforce its rights under this Agreement (whether in contract, tort, or both) or seeks a declaration of any rights or obligations under this Agreement, the prevailing party shall be awarded its reasonable attorney fees, and costs and expenses incurred.
 

13) ENTIRE AGREEMENT This Agreement and the Attachments hereto constitute the entire agreement between the contracting parties concerning the subject matter hereof. All prior agreements, discussions, representations, warranties and covenants are superseded herein. There are no warranties, representations, covenants or agreements, expressed or implied, between the parties except those expressly set forth in this agreement. Any amendments or modifications of this agreement shall be in writing and executed by the contracting parties.
 

14) IMAGE RELEASE I acknowledge and grant for due consideration, Tad & Associates, Ltd dba North Coast Barista School the right to broadcast, duplicate, distribute and/or televise my image, photograph or testimonial on its website or in other printed publications without further consideration, and all material herein agreed to, for advertising, promotion, educational or public service purposes. I hereby waive any claim to royalties or other payments in connection with the broadcast or other use of such material and further release and discharge Tad & Associates, Ltd dba North Coast Barista School, the advertiser or their agents, and all those acting under their authority, from any liability by virtue of any violation of any personal or property rights which I may have in connection with the broadcast or other use of such materials.
 

15) SHARING YOUR CONTACT INFORMATION North Coast Barista School will not share your contact information with other parties, but reserves the right to supply any or each of its sponsors with your email address.
 

16) COPYRIGHT All materials presented are owned by Tad & Associates, Ltd dba North Coast Barista School. Unauthorized duplication and use will be prosecuted to the fullest extent of the law.
